Court Approves Bail for El-Rufai, but Conditions Prevent Immediate Release
The Federal High Court in Kaduna has granted bail to former Kaduna State governor, Nasir Ahmad El-Rufai, following a hearing on Tuesday, April 14, 2026. However, his release from custody has been delayed due to stringent conditions imposed by the court, which must be fully met before he can be freed.
Bail Conditions and Legal Proceedings
Presided over by Justice Rilwan M. Aikawa, the court ordered that El-Rufai remain in the custody of the Independent Corrupt Practices and Other Related Offences Commission (ICPC) until all bail requirements are satisfied. Speaking to journalists after the proceedings, El-Rufai's son, Bello, outlined the conditions, which include a N200 million bond with two sureties in like sum. The sureties must include a recognized traditional ruler and a federal civil servant not below Grade Level 15.
Additional conditions require the submission of landed property documents, the deposit of international passports with the court, and a restriction preventing El-Rufai from making public comments related to the case. He is also expected to make himself available for all court proceedings. Bello noted that the conditions are numerous, close to 10 or more, but expressed hope that they would be fulfilled.
Separate Trials and Adjournments
El-Rufai is facing multiple legal battles. In a separate case before the Kaduna State High Court sitting in Kawo, he was arraigned alongside Amadu Sule, Managing Director of TMDK Terminal Limited, on charges including abuse of office, fraud, intent to commit fraud, and conferring undue advantage. However, the prosecution amended the charges on Monday, dropping Sule from the case and narrowing the trial to only El-Rufai.
The State High Court has adjourned the ruling on El-Rufai's bail application to Tuesday, April 21, 2026, due to the inability of the trial judge, Darius Khobo, to deliver the ruling as scheduled. Counsel to El-Rufai, Ubong Akpan, explained that the judge was bereaved and could not finalize the ruling, describing it as a circumstance beyond the court's control.
Legal Strategy and Criticisms
Akpan criticized the ICPC for pursuing multiple charges against El-Rufai in what he termed phased litigation, noting that the legal battle has extended beyond the state court to the Federal High Court in a parallel case. Following the State High Court session, El-Rufai was transferred to the Federal High Court, where he was arraigned on a separate 10-count charge before Justice Aikawa.
The court had earlier adjourned the hearing of the bail application in the federal case to April 14, 2026, for ruling. El-Rufai was escorted from the court premises by ICPC operatives in a white Hilux vehicle after the proceedings, highlighting the ongoing custody situation despite the bail grant.
As the legal processes continue, El-Rufai's defence team remains cautiously optimistic, awaiting the new dates for rulings and working to meet the bail conditions to secure his release from ICPC custody.
