Woman Divorces Husband Over Poverty in Kwara Court

An Area Court in Centre-Igboro, Ilorin, Kwara State, has officially dissolved the Islamic marriage between Toyin Ajibola and Bashirat Mohammed, citing severe financial difficulties as the primary reason for the separation.

The presiding judge, Hammad Ajumonbi, delivered the ruling, noting that while Toyin expressed a desire to remain married, Bashirat insisted on moving forward due to the ongoing economic strain.

Court Ruling and Custody Arrangements

According to the News Agency of Nigeria (NAN), Judge Ajumonbi dissolved the marriage and granted full custody of the couple's three children to Bashirat. The court also mandated that she observe the traditional three-month iddah waiting period before considering remarriage.

In addition, Toyin was ordered to be financially responsible for feeding their children. The judge emphasized that Toyin should have unrestricted access to the children, and Bashirat must make them available whenever he requests to see them.

Reasons for the Divorce Application

Earlier in the proceedings, Bashirat applied for divorce, stating that she was exhausted by her marriage due to a lack of money and her husband's perceived irresponsibility. She told the court, "I want the court to grant me divorce so that I can have rest of mind."

In response, Toyin acknowledged his financial struggles but expressed his continued interest in maintaining the marriage. He explained, "I have been trying hard to get money to feed my family, but couldn't. It is so painful that I can't get money to visit her and the children when they left home."

This case highlights the significant impact of economic hardship on marital relationships in Nigeria, particularly within Islamic legal frameworks. The court's decision underscores the importance of financial stability in family life, while also addressing the welfare of the children involved.
